1. About Us

Southern Sky Gallery ("we", "us", "our") is an online fine art and astrophotography print store operated by an individual based in Victoria, Australia. By accessing or purchasing from our website, you agree to these Terms of Service.

2. Acceptance of Terms

By placing an order or using our website, you confirm that you are at least 18 years old (or have parental/guardian consent) and agree to be bound by these terms.

3. Products

All prints are produced on demand by our print fulfilment partner (Gelato) and are custom-made to order. As a result:

  • Each item is produced specifically for you after purchase
  • Colours may vary slightly from screen to screen due to monitor calibration
  • Print dimensions are approximate and may vary by a small margin

4. Pricing & Payment

  • All prices are listed in Australian Dollars (AUD) and include GST where applicable
  • We reserve the right to change prices at any time without notice
  • Payment is processed securely at checkout; we do not store your payment details

5. Orders & Fulfilment

  • Orders are sent to our print partner within 1–2 business days of payment confirmation
  • Production typically takes 3–7 business days, followed by shipping
  • Delivery timeframes vary by location and are estimates only
  • We are not responsible for delays caused by our fulfilment partner or shipping carriers

6. Returns & Refunds

Because all products are custom-made to order, we do not accept returns or offer refunds for change of mind.

However, we will offer a reprint or refund if your order arrives:

  • Damaged in transit
  • With a print defect or quality issue
  • Incorrect (wrong item or size sent)

To request a remedy, you must contact us within 14 days of delivery with your order number and clear photos of the issue. We will assess each claim and, at our discretion, arrange a reprint or issue a refund.

This policy does not limit your rights under the Australian Consumer Law (ACL), which provides guarantees that cannot be excluded.

7. Australian Consumer Law

Our products come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

8. Shipping

  • We ship Australia-wide and internationally via our fulfilment partner
  • Shipping costs are calculated at checkout
  • We are not responsible for customs duties, import taxes, or delays caused by customs for international orders
  • Risk of loss passes to you upon handover to the carrier

9. Intellectual Property

All photography, artwork, and content on this website is owned by Southern Sky Gallery or its licensors. You may not reproduce, distribute, or use any content without our written permission. Purchasing a print grants you a personal, non-commercial licence to display it in your home or office only.

10. Limitation of Liability

To the extent permitted by law, our total liability to you for any claim arising from your use of this website or purchase of our products is limited to the amount you paid for the relevant order.

11. Privacy

We collect and handle your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). We do not sell your data to third parties.

12. Changes to These Terms

We may update these terms at any time. The current version will always be posted on this page with the updated date. Continued use of our website after changes constitutes acceptance.

13. Governing Law

These terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
